By accessing or using Brand Manager ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Brand Manager is a platform for creating, managing, and exporting brand assets including logos, color palettes, typography, taglines, and related brand materials. The Service uses AI-powered generation tools to assist in brand creation.

3. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload or generate content that infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the integrity of the Service
• Use automated means to access the Service beyond provided APIs

5. Intellectual Property

Brand assets you create using the Service are owned by you, subject to the terms of any third-party services used in generation (e.g., AI model providers). The Service itself, including its design, code, and branding, remains the intellectual property of Brand Manager.

6. Payment Terms

Certain features of the Service require tokens, which may be purchased or earned. Tokens are non-refundable and non-transferable. We reserve the right to modify pricing at any time with reasonable notice. Continued use of paid features after price changes constitutes acceptance of the new pricing.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Brand Manager shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Termination

We may terminate or suspend your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through binding arbitration.
